The attorneys at Atkin & Associates make a special effort to advance case law to help Utah's injured and promote injured worker friendly changes in state law and rules of the Labor Commission. Over the years, we have been involved in numerous court victories which continue to be used to help injured workers today.
AE Clevite v. Utah Labor Commission involved a man who worked from home to prepare for a company sales trip. He fell on an icy driveway while preparing for the trip and became quadruplegic. Liberty Mutual denied workers compensation benefits because he was working at home at the time of the accident. Dawn Atkin won benefits for the injured worker at the Labor Commission and, when the insurance company appealed, Gary Atkin protected those benefits and won a landmark decision for injured workers.
In a similar situation, Marsha Atkin represented a Utah police officer who was driving a police vehicle after hours and was in an accident. Because the officer was directed by her employer to drive the car in order to promote police presence and allow for emergency assistance, Atkin & Associates was able to get workers compensation benefits for her and excellent case law from the Utah Supreme Court. Dawn Atkin serves on many committees at the Utah Labor Commission as a representative of injured workers. Over the past year, she has been working on the goal of improving the Labor Commission and addressing problems first brought to light in a Get Gephart Story which resulted in a legislative audit of the Labor Commission. Tremendous advances have been made over the past year, and Dawn continues to volunteer her time to make the system work better for injured workers.
